FITNESS PARTICIPATION LIABILITY WAIVER & RELEASE OF CLAIMS

Stronger State, in association with Vitality Forged, LLC

1. Introduction and Acknowledgment

This Fitness Participation Liability Waiver and Release of Claims (the “Agreement”) governs participation in any fitness training, coaching, classes, events, or related activities (collectively, the “Activities”) offered by Stronger State, in association with Vitality Forged, LLC (the “Company”).

By choosing to participate in any Activities, individuals acknowledge that they have read, understood, and agreed to the terms outlined in this Agreement.

2. Assumption of Risk

Participation in physical fitness activities involves inherent risks, including but not limited to: muscle strains, sprains, fractures, cardiovascular complications, dehydration, heat-related illness, equipment-related injuries, and in rare cases, serious injury or death.

Participants voluntarily assume full responsibility for any risks, injuries, or damages, known or unknown, which may occur as a result of participation in the Activities, regardless of the cause.

3. Medical Acknowledgment and Responsibility

Participants affirm that they are in good physical condition and capable of engaging in physical exercise. Participants understand that the Company is not providing medical advice and that it is their responsibility to consult with a qualified healthcare provider prior to participation if they have any concerns regarding their health.

Participants agree to disclose any known medical conditions, injuries, or limitations that may affect their ability to safely participate and accept full responsibility for their health and well-being during all Activities.

4. Waiver and Release of Liability

To the fullest extent permitted by law, participants hereby release, waive, discharge, and covenant not to sue Stronger State, in association with Vitality Forged, LLC, including its owners, officers, employees, contractors, trainers, volunteers, agents, and affiliates (collectively, the “Released Parties”), from any and all claims, demands, damages, rights of action, or causes of action arising out of or related to participation in the Activities.

This includes, without limitation, any claims based on negligence, personal injury, property damage, or wrongful death.

5. Indemnification

Participants agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorney’s fees, arising out of or related to their participation in the Activities or their violation of this Agreement.

6. Conduct and Participation Standards

Participants agree to conduct themselves in a manner that is respectful, responsible, and supportive of all other participants and staff. The Company reserves the right to remove any participant from Activities at its sole discretion for behavior deemed unsafe, disruptive, or inappropriate.

Such removal may result in forfeiture of any fees paid and, depending on the nature and severity of the conduct, may result in further action as permitted by law.

7. Use of Equipment and Facilities

Participants acknowledge that improper use of equipment or failure to follow instructions may result in injury. Participants agree to use all equipment and facilities in a safe and responsible manner and to follow all guidance provided by the Company.

8. Media Release

Participants grant permission to the Company to capture and use photographs, video recordings, or other media of their participation for promotional, marketing, or educational purposes, without compensation, unless otherwise agreed in writing.

9. No Guarantees or Warranties

The Company makes no guarantees regarding fitness results, performance outcomes, or health improvements. Participation is voluntary, and results may vary based on individual effort, consistency, and other factors beyond the Company’s control.

10. Severability

If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

11. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the state in which the Company operates, without regard to its conflict of law principles.

12. Entire Agreement

This Agreement constitutes the entire understanding between the participant and the Company regarding liability and participation in the Activities and supersedes any prior agreements or representations.

13. Acceptance of Terms

By participating in any Activities offered by Stronger State, in association with Vitality Forged, LLC, individuals acknowledge that they have read this Agreement, understand its terms, and voluntarily agree to be bound by it.
